Please read these terms and conditions of sale («TCS») carefully before placing an order on the NostalGear.fr website. By placing an order on this website, you agree to be bound by these TCS. If you do not accept all the terms and conditions of this agreement, you may not place an order on this website.
1. Products and Orders
The products presented on the NostalGear.fr website are available for purchase while supplies last.
When you place an order, you agree to purchase the selected products at the price and under the conditions indicated on the website.
Our products include exclusively electronic hardware and technical configuration services. No third-party licensed software or files are provided with the products.
2. Price and Payment
Product prices are indicated in euros (EUR) and are subject to change at any time without notice.
Order payment is made online at the time of order confirmation by credit card, bank transfer, or any other payment method accepted on the site.
3. Delivery and Shipping Fees
Shipping fees are the customer's responsibility and are calculated based on the weight of the order, the delivery address, and the chosen shipping option.
Delivery times are estimated and may vary depending on the destination and the chosen shipping method.
4. Right of Withdrawal
In accordance with current legislation, you have a 14-day withdrawal period. However, at NostalGear we have opted for a much more flexible policy of 30 days upon receipt of your order to return the unused products and obtain a refund.
Return shipping costs are the customer's responsibility, except in the event of a manufacturing defect or an error on our part in the order.
The returned product must be complete, undamaged, and in its original packaging.
5. Warranty and Liability
Legal guarantees
Regardless of the commercial guarantees described below, the consumer benefits fully from the legal guarantee of conformity provided for in Articles L.217-3 et seq. of the Consumer Code as well as the guarantee against hidden defects provided for in Articles 1641 to 1649 of the Civil Code.
The legal guarantee of conformity applies for a period of two years from the delivery of the product, under the conditions provided by law.
NostalGear commercial warranties apply in addition to these legal warranties and do not limit, replace or reduce the rights enjoyed by the consumer under applicable legislation.
30-Day Return Policy
NostalGear offers a free 30-day return period from the date the product is received.
This warranty applies to the console as well as to controllers purchased in the same order as the console. It does not apply to controllers purchased separately.
To benefit from this guarantee, the customer must send their request to info@nostalgear.fr no later than 30 days after receiving the product.
Following customer service approval, the product must be shipped within 7 days according to the return instructions provided by NostalGear.
The product must be returned complete, with its accessories, in good condition and in its original packaging. Products showing significant deterioration attributable to the customer, in particular following an impact, a fall, contact with a liquid, mishandling or abnormal use, are excluded from this commercial warranty.
Under this commercial warranty, return shipping costs are the responsibility of the customer, except when the return is due to a product defect covered by an applicable warranty claim.
The refund is issued after receipt and verification of the product by NostalGear.
From the fifteenth day after receiving the product through the thirtieth day, the refund covers the price actually paid for the console and, where applicable, any controllers purchased with it. Original shipping charges are not refunded under this extended return policy.
During the legal withdrawal period, the applicable legal provisions remain fully applicable. In particular, the initial standard delivery costs are refunded in accordance with the law. Any additional costs resulting from the choice of a more expensive delivery method than standard delivery are not refunded.
For returns made under this commercial policy between the fifteenth and thirtieth day, NostalGear issues the refund within 14 days after receiving and inspecting the returned product.
Refunds are made using the payment method used for the order, unless otherwise agreed with the customer. The time required for the bank or payment provider to actually credit the funds after the refund has been issued does not depend on NostalGear.
«Lifetime» commercial warranty»
The NostalGear console automatically comes with a free commercial warranty known as a «lifetime» warranty, with no additional registration required.
Under this warranty, the expression «lifetime» refers to the period during which the product in question remains actively marketed by NostalGear.fr.
The commercial warranty ends when NostalGear ceases the commercialization of the product concerned. The termination of this commercial warranty has no effect on the legal guarantees enjoyed by the consumer, which continue to apply under their own conditions and for their own durations.
The «lifetime» commercial warranty covers the console, power cable, HDMI cable, power supply unit, and SD card.
Controllers, their dongles, and their cables do not benefit from this «lifetime» commercial warranty. They remain covered by applicable legal guarantees, notably the legal guarantee of conformity.
The «lifetime» commercial warranty covers the parts and labor required in the event of a breakdown, material defect, manufacturing defect, or software defect covered by this warranty.
Depending on the nature of the identified problem, NostalGear determines the appropriate support solution, including the repair or replacement of the product or the concerned element.
To benefit from this guarantee, the customer must contact customer service in advance at info@nostalgear.fr. No products may be returned before receiving shipping instructions from NostalGear.
Evidence to identify the original order must be provided. This may include an invoice, an order number, or a confirmation email.
The commercial warranty can be transferred to a new owner of the product, provided that they can provide proof allowing the original order to be identified.
The terms of support, in particular the organization of the product return, are communicated by customer service when the warranty claim is opened.
The commercial warranty does not cover damage resulting from a drop, impact, contact with a liquid, mishandling, abusive use, or use not in accordance with the product's intended purpose or the instructions in the manual.
Also excluded are damages resulting from the opening of the product, a repair, a modification, or an intervention carried out by the customer or by a third party not authorized by NostalGear.
The warranty does not cover normal wear and tear resulting from use or the natural aging of the product when it does not result from a covered breakdown or defect.
Purely cosmetic damage that does not affect the functioning of the product, including scratches, surface wear, or discoloration, is not covered.
NostalGear does not guarantee the preservation of data present on the SD card or in the system during a repair, replacement, or reset.
When a product or component is replaced under the commercial warranty, the replaced product or component becomes the property of NostalGear.
A replacement under the commercial warranty does not create a new warranty period. The replacement product or component remains covered within the limits and for the duration of the initial commercial warranty.
Territorial extent
NostalGear's commercial warranties apply in all countries to which NostalGear.fr offers delivery.

6. Intellectual Property
The content of the NostalGear.fr website, including certain texts, images, videos, and logos, is protected by intellectual property laws and is the property of NostalGear.fr or its licensors.
7. Use of Hardware and Digital Content
Our products are sold as computer hardware.
The user is solely responsible for the installation and use of software, files, or games on the purchased hardware.
Any installation of digital content must be done in compliance with current laws, particularly regarding copyright and intellectual property.
8. Modification of the GTC
NostalGear.fr reserves the right to modify these terms and conditions at any time. The modifications will take effect as soon as they are published on the website.
It is your responsibility to regularly check these T&Cs to be aware of any modifications.
9. Legal Disclaimer
By purchasing our products, you acknowledge that NostalGear.fr only offers hardware and technical configuration services.
The use of our equipment must comply with current legislation and respect the rights of digital content owners.
NostalGear.fr declines all responsibility in the event of any unlawful use of products purchased on our site.
